Terms of Service

By using the Service, you confirm that:

• You are 18 years of age or have consent from a legal representative
• You have the right to enter into contracts
• You provide accurate information
• You agree to these Terms of Service
• You agree to the Privacy Policy

3.1. Functionality:

• Client work automation
• Integration with WhatsApp via our own WhatsApp Web.js server (open source, Apache license)
• Synchronization with Google Calendar
• AI-powered message generation and personalization using Azure OpenAI
• Automatic invoice generation through Kaspi Pay integration (for clients)
• CRM system for client database management
• Task and schedule management
• Analytics and reporting

3.2. Availability:

We strive to ensure 24/7 availability of the Service, but do not guarantee uninterrupted operation. Scheduled maintenance and unforeseen failures may occur.

4.1. Account creation:

• Provide accurate information during registration
• Choose a strong password
• Do not share access credentials with third parties
• Immediately report account compromise

4.2. Responsibility:

You are fully responsible for all actions performed under your account. The Company is not responsible for damage caused by unauthorized use of your account.

5.1. Permitted use:

• Using the Service for commercial purposes
• Business process automation
• Integration with permitted third-party services
• Creating and managing client database

5.2. Prohibited use:

• Violation of the legislation of the Republic of Kazakhstan
• Distribution of spam or unwanted information
• Attempts to hack or breach security
• Use for illegal activities
• Violation of intellectual property rights
• Creating fake accounts

6.1. Company rights:

• All rights to the Service belong to the Company
• Copying, modification, or distribution is prohibited
• Reverse engineering is prohibited
• Trademarks are protected by law

6.2. User content:

You retain rights to your content, but grant the Company a license to use it to provide the Service. You guarantee that you have rights to the posted content.

7.1. Service cost:

• Cost is specified in the public offer
• Payment is made in advance
• Prices may change with notice
• Payment is reoccuring and will be charged to your account automatically until you cancel your subscription

7.2. Refund:

Refund is possible within 7 days from activation if there is no active use. Payment system fees are not refundable.

8.1. General limitations:

• Service is provided "as is"
• Uninterrupted operation is not guaranteed
• Liability for indirect damages is limited
• Maximum liability is the cost of services

8.2. Exceptions:

Limitations do not apply in cases of intentional harm, gross negligence, or violation of basic consumer rights.

9.1. Grounds for termination:

• Violation of these Terms
• Non-payment of services
• Use for illegal activities
• Security breach
• At User's initiative

9.2. Consequences of termination:

• Access to the Service is terminated
• Data may be deleted
• Refund according to contract terms
• Confidentiality obligations remain

10.1. Open source components:

The Service uses third-party open-source software components, including but not limited to WhatsApp Web.js, which is licensed under the Apache License 2.0.

10.2. License compliance:

We comply with all requirements of open-source licenses used in the Service, including maintaining copyright notices, providing license texts, and stating any modifications made to the original software. Information about third-party licenses can be found in the Service documentation or by contacting support.

10.3. License texts:

Copies of open-source licenses, including the Apache License 2.0 for WhatsApp Web.js, are available in the respective open-source project repositories or upon request.

12.1. Pre-trial procedure:

All disputes are resolved through negotiations. If agreement cannot be reached within 30 days, the dispute is referred to the court at the Company's location.

12.2. Applicable law:

These Terms are governed by the legislation of the Republic of Kazakhstan.
